I've yet to see any of these penalties/orders actually excuse or lessen the penalty due to reliance on these over-relied-upon legal agreements. I've been party to several calls between these various third parties and their FI clients and every single one relies upon the legal agreement which is always pretty vanilla language. We've seen several orders relating to the myriad of third-party usage - from outsourced compliance staffing, to risk assessment performance, #fintech relationships, #audit engagement, and #regtech solutions. I think if we had to pick a theme for orders and penalties for US FIs thus far for 2023, it would be just because your FI outsources a function to a third party and have really good legal language, it does not prevent your FI from being criticized or penalized. While this is not an exciting document, it shows that the basics are important, #CIP still matters, and even old mistakes can be expensive 8 years later.
